Mr Katz Travel: Terms & Conditions

We share these Terms & Conditions to make clear how we work, so we can build a smooth and successful relationship with you.

Since 1989, Operations trading as Mr Katz Travel ("MRKATZ") is a privately owned travel consultancy and an independent affiliate of Fora ("FORA"). Fora is a member of AFTA, IATA, CLIA, and an ATAS accredited Travel Agent Company.

References in these terms to MRKATZ include any related body corporate, director, employee or agent of MRKATZ, and also FORA where applicable. A reference to a "supplier" is a reference to a third party supplying travel services to you, such as air travel, car hire, accommodation, insurance, rail travel, or any other travel related service or product.

These terms govern your arrangements with MRKATZ and apply to all bookings we make on your behalf.

Our Role: We Are a Travel Agency Only

MRKATZ is a travel agency. Our service is to plan your itinerary and to organise and coordinate travel arrangements for you. We do this by connecting you with suppliers who provide the actual travel services.

When you book travel through us, a direct contract is formed between you and each supplier. That contract is governed by the supplier's own terms and conditions. MRKATZ is not a party to that contract, is not the agent of the supplier, and is not the provider of the travel services. We do not own, operate, control or guarantee any supplier or any service a supplier provides.

This means that, to the extent permitted by law, MRKATZ is not responsible for and accepts no liability for the acts, omissions, default, insolvency, delay, cancellation or failure of any supplier, or for any loss, damage, injury, delay or additional expense you suffer as a result. If a supplier does not deliver what you paid for, your claim is against that supplier, not against MRKATZ or FORA.

Payments

Payment for your travel is made to, and handled by, the relevant supplier (for example the airline, hotel, cruise line or insurer). In most cases your nominated payment method is charged directly by the supplier. By giving us your payment details you authorise us to pass them to the relevant supplier so the supplier can take payment. MRKATZ does not hold supplier funds on your behalf and is not responsible for processing, securing or refunding supplier payments.

MRKATZ charges its own service fees separately (see Fees below). These are paid directly to MRKATZ and are the only amounts payable to us.

Direct deposits can take time to clear, so please send any funds at least 3 business days before a payment due date to avoid cancellation and associated fees.

Card payments may attract a surcharge only where the law allows it, and any surcharge will not exceed our or the supplier's actual cost of accepting that card. We will tell you the amount of any surcharge before you pay.

Prices

All prices are subject to availability and can be withdrawn or varied without notice. Prices can change due to currency movements, fuel surcharges, taxes and other supplier increases outside our control. Until your booking is paid in full, any increase may be passed on to you. We take care to ensure pricing is correct when quoted and updated at the time of payment where required. Prices are quoted in US dollars and include GST where applicable, unless stated otherwise.

Fees

MRKATZ charges fees including planning fees, booking fees, change fees and cancellation fees, in accordance with our fee schedule. These fees are non-refundable and are separate from any fees a supplier may charge. By instructing MRKATZ to make any booking on your behalf, you agree to pay these fees. Our current fee schedule is provided to you with these terms, and applies to all bookings.

Commission

MRKATZ may receive or retain commission, rebates and incentives from suppliers in connection with bookings made on your behalf. Any such commission is the property of MRKATZ.

Cancellations and Amendments

Travel arrangements may be non-refundable and non-changeable. If you cancel a confirmed booking you are likely to incur fees. MRKATZ charges cancellation and amendment fees in accordance with our fee schedule, in addition to any fees imposed by suppliers.

It is your responsibility to check a supplier's amendment and cancellation terms before you book. We will use our best endeavours to give you current information about supplier fees. If you are unsure where to find them, please ask and we will help.

Refunds

If you cancel and a refund is due, that refund comes from the supplier. We can only pass a refund to you once the supplier has released the money to us. Where we are able, we will tell you the expected timeframe, which can be up to 12 weeks. Supplier refunds are sometimes issued as a credit rather than cash, and that is the supplier's decision, not ours.

Chargebacks

If you dispute or reverse a payment for a valid booking (a chargeback), you remain liable for the full amount of that booking together with any fees, charges and reasonable costs we incur in responding to the dispute. You agree not to raise a chargeback before first raising the issue with us under the Complaints section below.

Schedule Changes

We make every effort to tell you about schedule changes in good time. Even so, please check your flight times 24 hours before each departure, as airlines may change schedules as they see fit. To the extent permitted by law, MRKATZ is not responsible for and accepts no liability arising from any schedule change made by an airline, or for any onward travel or arrangements affected by it.

Your Responsibilities and Indemnity

You are responsible for the accuracy of all information you give us, including names, dates, passport details and special requirements. You must check all documents and itineraries we provide and tell us promptly about any error.

To the extent permitted by law, you agree to indemnify MRKATZ and FORA against any loss, damage, cost, fee or claim we suffer or incur as a result of your breach of these terms, your negligence, incorrect or incomplete information you provide, or a chargeback you raise.

Limitation of Liability

To the extent permitted by law, and subject to the Australian Consumer Law section below:

  • MRKATZ and FORA are not liable for any indirect, special or consequential loss, including loss of enjoyment, loss of profit or loss of opportunity.

  • Where MRKATZ or FORA is found liable to you for any reason, that liability is limited in total to the amount of the service fees you paid to MRKATZ for the affected booking. We are not liable for the cost of the travel services themselves, which are supplied by, and paid to, the supplier.

Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where MRKATZ is permitted to limit its liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again. If any part of these terms is inconsistent with the Australian Consumer Law, that law prevails to the extent of the inconsistency.

Force Majeure

MRKATZ and FORA accept no liability for any loss or damage you suffer as a result of MRKATZ, FORA or any supplier being unable to perform its obligations due to unusual or unforeseeable circumstances beyond reasonable control (a "force majeure event"), including natural disaster, severe weather, pandemic, government action, strikes, war or civil unrest.

No Warranty and Accuracy of Information

MRKATZ gives no warranty and makes no representation about the suitability or adequacy of any supplier's services or products. If a supplier's services or products are not supplied as you expected, your remedy is against the supplier, not MRKATZ or FORA.

We take reasonable care that information we give you is correct and provide it in good faith. Information may change without notice, and we cannot and do not check the accuracy of all information provided by suppliers. To the extent permitted by law, MRKATZ is not responsible for any error, omission or misleading information provided by a supplier. You should make your own evaluation of the accuracy, completeness and legitimacy of any information, opinion or advice provided.

Privacy and Your Personal Information

To arrange your travel we collect personal information from you, which may include your name, contact details, date of birth, passport details, next of kin, payment details, and health or dietary information where relevant.

We use this information to make and manage your bookings. To do that, we share it with the suppliers involved in your travel and with third parties such as airlines, hotels, insurers and booking systems. Some of these are located overseas, which means your information may be disclosed outside Australia. By giving us your information and instructing us to book, you consent to us collecting, using and disclosing it in this way.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. You can ask us to access or correct your information, or raise a privacy concern, by contacting us. Our privacy policy sets out how we manage personal information in full and is available on request.

At the time you confirm your arrangements, you must give us a copy of the passport details page for every member of your travelling party.

Emergency Disclosure

If a natural disaster or other emergency occurs in a country you are visiting, you authorise MRKATZ to disclose your contact information, next of kin and itinerary to the Australian Department of Foreign Affairs and Trade.

Lead Booker Authority

If you make a booking for more than one person, you are the lead booker. You confirm that you are authorised to make the booking and to accept these terms on behalf of every person in your party, that you have their consent to provide their personal information, and that you will pass on all relevant documents and information to them. You are responsible for all payments due for the booking.

Passports and Visas

All travellers must hold a valid passport with at least 6 months validity beyond the length of the intended stay. Some countries require longer. Before confirming your arrangements, it is your responsibility to ensure your passport meets the entry conditions of every country you are visiting or passing through.

Some countries require an entry visa or permit. It is your responsibility to obtain the necessary visas and permits. We recommend you check requirements with the relevant Embassy, High Commission or Consulate, and allow enough time, ideally at least 3 months before travel.

If you are travelling to the United States, you must register under the Visa Waiver program before departure. See https://esta.cbp.dhs.gov/esta to apply and for more information.

Permanent Australian residents travelling on a foreign passport must hold a valid Resident Return Visa to re-enter Australia. It is your responsibility to hold the documentation needed to return to Australia.

The name on any airline ticket must match the name on your passport, including middle names. It is your responsibility to confirm this is correct before ticketing. Any cancellation or amendment fees caused by incorrect names may be passed on to you.

Travel Insurance

MRKATZ strongly recommends you take out comprehensive travel insurance at the time you book and pay. We can help with quotes, but it is your responsibility to ensure you and any dependents have adequate cover, and to read and understand the Product Disclosure Statement before you buy. If you decline travel insurance, we may ask you to sign a disclaimer.

Health and Vaccination Requirements

Some countries require vaccinations before granting entry. General health advice is available at smarttraveller.gov.au. We recommend you consult your doctor or a travel clinic early in your planning so you have time to arrange any vaccinations.

Complaints

If something goes wrong, please tell us as soon as possible, and within 30 days of returning from travel, so we have the chance to help resolve it. Many issues are matters for the supplier, but we will assist where we can. You agree to raise any concern with us under this section before commencing legal proceedings or raising a chargeback.

Governing Law

These terms are governed by the laws of New South Wales. You submit to the non-exclusive jurisdiction of the courts of New South Wales and any relevant tribunals for any dispute concerning these terms. We may assign our rights and obligations under these terms at any time by giving you notice.

General

If any part of these terms is found to be void or unenforceable, that part is severed and the rest of the terms continue to apply. We may update these terms from time to time, and the version current at the time of your booking applies. These terms, together with our fee schedule and any booking confirmation, make up the whole agreement between us.

Acknowledgement

Instructing MRKATZ, or paying any funds to MRKATZ or a supplier in connection with a booking, means you acknowledge and accept these terms and conditions, unless you tell us otherwise in writing beforehand.
